1. Who you are dealing with

Te Pātaka Pouako is operated by Kawana J Wallace (the "seller", "we"), based in Aotearoa New Zealand. By using the platform you are contracting with the seller, and by continuing to use it you accept these terms.

2. Using Te Pātaka Pouako

Te Pātaka Pouako provides resource generators for educators. Free tools may be used without an account. Paid plans (Kaiako Individual Pass and Kura / Syndicate Pass) are billed monthly and may be cancelled at any time from your account page; access continues until the end of the paid period. We grant you a limited, non-exclusive, non-transferable right to use the service within your chosen plan. You are responsible for keeping your sign-in credentials confidential and for activity under your account.

3. Payments, billing and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms.

Refund policy: we offer a 30-day money-back guarantee. If you are not satisfied with a purchase, you can request a full refund within 30 days of your order date. Refunds are processed by our payment provider, Paddle. To request a refund, visit paddle.net or contact us.

4. Kura / Syndicate seats

A Kura Pass includes six kaiako seats. The Kura admin may assign, reassign or remove seats. Additional seats are billed at $5 NZD per seat per month, prorated when added or removed. Seat holders receive Pro access while the Kura Pass remains active.

5. Copyright of generated resources

You own the word lists, clues and other content you enter, and you grant us a limited licence to host and process it solely to provide the service. Resources you generate (crosswords, worksheets, answer keys) are yours to print, copy and use freely in your classroom, kura and syndicate, including for non-commercial sharing with colleagues. Reselling generated resources as standalone products is not permitted. The platform, its software, design, tool logic, templates and branding remain the intellectual property of the seller.

6. Acceptable use

You must not misuse the service: no unlawful use, fraud or spam, infringement of others' intellectual property, or interference with security (malware, probing, scraping, circumventing plan limits, reverse engineering or reselling access). Do not create material that is discriminatory or harmful.

7. Service level and liability

We aim for reliable service but do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by New Zealand law we disclaim implied warranties, exclude liability for indirect or consequential loss, and cap our total liability to the fees you paid in the preceding twelve months. Nothing in these terms limits rights under the Consumer Guarantees Act 1993 that cannot be excluded.

8. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated policy violations. If your account ends, saved resources are preserved for 12 months so you can resubscribe or request an export, after which they may be deleted.

9. Governing law and changes

These terms are governed by the laws of New Zealand and disputes are subject to the New Zealand courts. We may update these terms from time to time; material changes will be noted on this page with a new date.
